These Terms and Conditions govern the use of Guestlist – Nightlife Made Easy, a platform owned and operated by Crazinerd (Pty) Ltd.

Guestlist is a nightlife, guestlist, event discovery, RSVP, venue, host, subscription, messaging, verification, and listing platform. The platform allows event goers to discover guestlist listings, request RSVP approval, receive event details, interact with hosts, and attend nightlife venues. It also allows approved hosts, venues, club owners, promoters, and event organisers to create and manage listings, approve or reject RSVPs, communicate with users, and promote events.

These Terms are based on the Guestlist platform functionality, including paid goer access, host listings, ID verification, RSVPs, reviews, messaging, QR code identity confirmation, boosted listings, PayFast payments, and location-based discovery.

By using Guestlist, creating an account, uploading content, submitting your ID, verifying your phone number, paying for a subscription, creating a listing, RSVPing to an event, messaging another user, submitting a review, or using any feature of the platform, you agree to these Terms.

If you do not agree to these Terms, you must not use Guestlist.


1. Definitions

In these Terms:

“Crazinerd”, “we”, “us”, or “our” means Crazinerd (Pty) Ltd, registration number 2017/187432/07, the owner and operator of Guestlist.

“Guestlist” means the mobile application, website, platform, services, features, listings, dashboards, subscriptions, RSVP tools, messaging features, QR code features, verification systems, payment features, host tools, and related services provided under the Guestlist brand.

“User” means any person who accesses or uses Guestlist.

“Goer” means a user who uses Guestlist to discover events, view guestlists, RSVP to listings, communicate with hosts, or attend venues.

“Host” means a venue owner, club owner, promoter, event organiser, restaurant owner, outdoor venue operator, or approved person or business that creates or manages listings on Guestlist.

“Venue” means a club, restaurant, outdoor venue, event space, or other location listed on Guestlist.

“Listing” means a guestlist, event, venue promotion, recurring listing, boosted listing, or similar listing created on Guestlist.

“RSVP” means a request by a goer to be added to a guestlist.

“Approved RSVP” means an RSVP accepted by a host.

“Rejected RSVP” means an RSVP declined by a host.

“Subscription” means a paid access plan offered by Guestlist.

“Boost” means a paid promotional feature that may increase the visibility of a listing.

“Content” means text, images, videos, profile details, reviews, messages, listing information, venue information, social media handles, addresses, documents, and any other information submitted to Guestlist.

“Personal Information” has the meaning given to it under the Protection of Personal Information Act, 4 of 2013.

“POPIA” means the Protection of Personal Information Act, 4 of 2013.


2. Eligibility and Age Restriction

Guestlist is only available to persons who are 18 years or older.

You may only use Guestlist if:

  1. You are at least 18 years old.
  2. You can enter into a legally binding agreement.
  3. You provide accurate and truthful information.
  4. You comply with these Terms.
  5. You comply with all applicable laws.
  6. You have not been suspended or banned from the platform.

No person under the age of 18 may create an account, access guestlist listings, RSVP, attend events through Guestlist, create host listings, or use the platform.

Crazinerd may request proof of age or identity at any time.

If we reasonably believe that you are under 18, we may suspend or permanently delete your account.


3. Account Registration

To access Guestlist, you must create an account or log in.

You agree to:

  1. Provide accurate, current, and complete information.
  2. Keep your login details secure.
  3. Not share your account with another person.
  4. Not create fake, duplicate, or misleading accounts.
  5. Not impersonate any person, host, venue, business, or organisation.
  6. Keep your phone number, email address, profile details, and payment information up to date.
  7. Notify us immediately if you suspect unauthorised access to your account.

You are responsible for all activity that happens under your account.


4. Goer Accounts

Goers may be required to provide:

  1. Name and surname.
  2. Email address.
  3. Cellphone number.
  4. Profile picture.
  5. Brief bio.
  6. Social media handles.
  7. Age or date of birth.
  8. Gender.
  9. Gallery photos or videos.
  10. ID document or proof of age.
  11. Location access.
  12. Payment information.
  13. Phone verification.

Goers may be required to verify their cellphone number before being allowed to RSVP.

Only one cellphone number may be linked to one account. This helps prevent duplicate accounts, fake RSVPs, fraud, spam, and misuse.


5. Host and Venue Accounts

Hosts may be required to submit information before being approved on the platform.

This may include:

  1. Personal profile details.
  2. Business or venue details.
  3. ID document.
  4. Venue name.
  5. Venue address.
  6. Venue contact details.
  7. Venue Instagram handle.
  8. Venue photos or videos.
  9. Venue category.
  10. Dress code.
  11. Age restriction.
  12. Guestlist preferences.
  13. Maximum number of guestlist spaces.
  14. Guestlist benefits.
  15. Required arrival time.
  16. Arrival procedure.
  17. Host contact details.
  18. Any additional information required by Crazinerd.

Crazinerd may approve, reject, suspend, or remove host accounts at its discretion if we believe the host is not legitimate, unsafe, misleading, inactive, fraudulent, unlawful, or in breach of these Terms.


6. Verification and Blue Tick Status

Guestlist may provide verified users or hosts with a verification indicator, such as a blue tick.

Verification may mean that a user or host has submitted certain information, such as an ID document, cellphone number, business details, or profile information.

Verification does not mean that Crazinerd guarantees the safety, honesty, quality, reliability, behaviour, or suitability of any user, host, venue, listing, or event.

Crazinerd may remove verification at any time if:

  1. Submitted information is false or misleading.
  2. The account changes ownership.
  3. The user breaches these Terms.
  4. The account becomes inactive.
  5. The account appears suspicious.
  6. Crazinerd reasonably believes verification should no longer apply.

7. ID Documents and Age Verification

Because Guestlist is an adult nightlife platform, Crazinerd may require users and hosts to upload ID documents or other proof of age or identity.

By submitting your ID or verification documents, you confirm that:

  1. The document is genuine.
  2. The document belongs to you.
  3. The information is accurate.
  4. You are at least 18 years old.
  5. Crazinerd may process the document for verification, fraud prevention, safety, legal compliance, and platform integrity.

We may reject, suspend, or delete accounts where verification fails or where we suspect fake documents, false information, or underage use.


8. Subscription Access

Goers may be required to pay a monthly subscription, including a possible fee of R50 per month, to access guestlist listings and related platform features.

Unpaid users may have limited or no access to listings, RSVPs, event details, host information, location-based discovery, or other features.

Subscription pricing, benefits, access rules, and billing cycles may change from time to time.

Where required, Crazinerd will take reasonable steps to notify users of material subscription changes.


9. Payments

Payments may be processed through PayFast or another third-party payment provider.

By making a payment, you agree to:

  1. Pay all applicable fees.
  2. Provide accurate payment information.
  3. Authorise the payment provider to process your payment.
  4. Comply with the payment provider’s terms.
  5. Ensure your selected payment method has sufficient funds.

Crazinerd does not control third-party payment systems and is not responsible for payment failures caused by banks, payment providers, card issuers, insufficient funds, network issues, incorrect details, or third-party outages.


10. Refunds

Unless required by law or expressly stated otherwise:

  1. Subscription payments are non-refundable once access has been granted.
  2. Boost payments are non-refundable once the boost has started.
  3. Payments for digital access, visibility, platform features, subscriptions, or promotional tools are generally non-refundable.
  4. No refund is due if you do not use the platform after paying.
  5. No refund is due if your RSVP is rejected.
  6. No refund is due if a venue refuses you entry.
  7. No refund is due if you fail to follow dress code, arrival time, age restriction, or venue rules.
  8. No refund is due if your account is suspended or terminated for breaching these Terms.

Crazinerd may consider refunds at its discretion in cases such as duplicate billing, technical error, fraud, or exceptional circumstances.


11. Cancellation of Subscription

You may cancel your subscription through the available app, payment provider, app store, or platform cancellation process.

Cancellation stops future billing but does not automatically entitle you to a refund for the current billing period.

Your access may continue until the end of the paid billing period, unless otherwise stated.


12. Listings

Approved hosts may create listings for venues, guestlists, events, promotions, or recurring events.

Listings may include:

  1. Venue name.
  2. Venue address.
  3. Venue images or videos.
  4. Venue Instagram handle.
  5. Venue type.
  6. Dress code.
  7. Age restriction.
  8. Gender preference, where legally permitted.
  9. Maximum guestlist capacity.
  10. Guestlist benefits.
  11. Arrival time.
  12. Arrival procedure.
  13. Host contact details.
  14. Event date and time.
  15. Recurring event settings.
  16. Other event or venue details.

Hosts are responsible for ensuring that listing information is accurate, lawful, clear, updated, and not misleading.

Crazinerd may edit, reject, hide, suspend, or remove listings that are inaccurate, unsafe, discriminatory, unlawful, offensive, misleading, inactive, spammy, fraudulent, or in breach of these Terms.


13. Recurring Listings

Hosts may be allowed to create recurring listings.

Recurring listings may automatically update weekly or according to platform rules.

Hosts are responsible for checking that recurring listings remain accurate, including date, time, venue, capacity, benefits, dress code, arrival procedure, and RSVP rules.

Crazinerd is not responsible for disputes, confusion, loss, or incorrect guestlist information caused by a host failing to update a recurring listing.


14. Boosted Listings

Hosts may pay to boost listings so that they appear more prominently on Guestlist.

Boosting does not guarantee:

  1. A specific number of views.
  2. A specific number of RSVPs.
  3. Approval of any RSVP.
  4. Attendance at the venue.
  5. Revenue or sales.
  6. Business growth.
  7. Top placement at all times.
  8. Any specific result.

Boost performance may depend on location, user activity, timing, competition, listing quality, user interest, platform algorithms, and account status.

Crazinerd may reject or remove boosted listings that breach these Terms.


15. RSVP Requests

Goers may request to be added to a guestlist by submitting an RSVP.

An RSVP is only a request until approved by the host.

Submitting an RSVP does not guarantee:

  1. Entry into a venue.
  2. Free entry.
  3. Discounted entry.
  4. Drinks, hubbly, food, VIP access, or other benefits.
  5. Approval by the host.
  6. Acceptance by venue door staff.
  7. Space availability.
  8. That the event will take place.
  9. That the venue will honour the listing exactly as described.

Hosts may approve, reject, or cancel RSVPs according to venue rules, capacity, age restrictions, dress code, arrival time, safety, and operational requirements.


16. Approved RSVPs

If your RSVP is approved, you may receive event details by app notification, email, WhatsApp, SMS, or another available communication method.

Approved RSVP details may include:

  1. Venue name.
  2. Venue address.
  3. Arrival time.
  4. Guestlist procedure.
  5. Dress code.
  6. Host contact details.
  7. QR code or profile confirmation.
  8. Guestlist benefits.
  9. Important instructions.

You are responsible for reading and following these instructions.

Failure to arrive on time, bring valid ID, follow the dress code, comply with venue rules, or behave appropriately may result in refusal of entry.


17. Venue Entry

Guestlist does not control venue door policies.

Final entry decisions may be made by the venue, host, promoter, security, door staff, or management.

A venue may refuse entry for reasons including:

  1. Age restrictions.
  2. No valid ID.
  3. Dress code.
  4. Late arrival.
  5. Capacity limits.
  6. Safety concerns.
  7. Intoxication.
  8. Aggressive or inappropriate behaviour.
  9. Venue policy.
  10. Legal requirements.
  11. Fraudulent RSVP or QR code misuse.

Crazinerd is not liable if you are refused entry by a venue.


18. QR Codes and Identity Confirmation

Guestlist may provide QR codes on user profiles or RSVPs for identity confirmation, profile viewing, check-in, or guestlist management.

You agree not to:

  1. Share your QR code with another person.
  2. Sell or transfer your RSVP.
  3. Use another person’s QR code.
  4. Screenshot, copy, manipulate, or fake QR codes.
  5. Attempt to bypass verification or check-in systems.

Misuse of QR codes may result in suspension or permanent banning.


19. Host RSVP Management

Hosts may view RSVP lists and approve or reject users.

Hosts may also use mass approve or mass reject tools where available.

Hosts must use RSVP tools lawfully, fairly, responsibly, and only for legitimate event and guestlist management.

Hosts must not use RSVP information to harass, discriminate unlawfully, spam, intimidate, exploit, or misuse goers.

Hosts are responsible for complying with applicable laws and venue policies when managing guestlists.


20. Guestlist Reports and Host Notifications

Guestlist may send hosts guestlist information by email, WhatsApp, app notification, dashboard, or other communication channels.

This may include:

  1. Names and surnames of approved goers.
  2. RSVP status.
  3. Event details.
  4. Guestlist summaries.
  5. Arrival information.
  6. Contact or operational information.

Hosts must protect this information and use it only for lawful guestlist and event management purposes.

Hosts must not publish, sell, share, misuse, or retain goer information for unrelated purposes.


21. Reviews

Goers may submit reviews of venues, hosts, events, or experiences.

Reviews may be moderated before publication.

Crazinerd may approve, reject, edit, hide, or remove reviews that:

  1. Are false or misleading.
  2. Are abusive, threatening, hateful, or discriminatory.
  3. Contain private information.
  4. Contain spam or advertising.
  5. Are unrelated to the venue or event.
  6. Contain inappropriate language.
  7. Violate another person’s rights.
  8. Create legal risk.
  9. Breach these Terms.

Submitting a review does not guarantee that it will be published.


22. Messaging

Guestlist may provide messaging features between users, hosts, venues, and support.

You agree not to use messaging to:

  1. Harass or threaten anyone.
  2. Send spam.
  3. Send illegal content.
  4. Send abusive or offensive messages.
  5. Scam, impersonate, or deceive others.
  6. Share private information without consent.
  7. Sell illegal goods or services.
  8. Move users off-platform for fraud or abuse.
  9. Send malware, harmful links, or suspicious content.

Crazinerd may monitor, restrict, remove, or investigate messages where necessary for safety, moderation, fraud prevention, legal compliance, or platform integrity.


23. Location Services

Guestlist may use your location to show listings near you.

Location data may be collected from:

  1. Device GPS.
  2. Approximate location.
  3. Selected city or area.
  4. IP address.
  5. User-provided location information.

You may disable location access through your device settings, but some features may not work properly.

Crazinerd does not guarantee that location-based listings will always be accurate, nearby, complete, available, or relevant.


24. Notifications, Emails, WhatsApp, and SMS

By using Guestlist, you agree that Crazinerd may contact you through app notifications, email, WhatsApp, SMS, phone, or other communication channels where reasonably necessary.

Communications may include:

  1. RSVP confirmations.
  2. RSVP rejections.
  3. Event reminders.
  4. Guestlist details.
  5. Payment confirmations.
  6. Subscription notices.
  7. Security alerts.
  8. Verification messages.
  9. Support messages.
  10. Platform updates.
  11. Promotional messages, where permitted.

You may opt out of certain marketing communications, but we may still send important service, safety, payment, legal, security, verification, and account-related messages.


25. User Content

You retain ownership of content you upload.

However, by uploading content to Guestlist, you grant Crazinerd a worldwide, non-exclusive, royalty-free licence to use, host, store, display, reproduce, resize, crop, moderate, distribute, publish, and process your content for the operation, marketing, safety, moderation, improvement, and promotion of Guestlist.

This includes:

  1. Profile pictures.
  2. Gallery photos.
  3. Videos.
  4. Bios.
  5. Listing images.
  6. Venue images.
  7. Reviews.
  8. Messages.
  9. Social media handles.
  10. Event and venue information.

You confirm that:

  1. You own the content or have permission to use it.
  2. The content does not infringe another person’s rights.
  3. The content is not illegal, harmful, misleading, or abusive.
  4. The content does not contain private information without consent.
  5. The content complies with these Terms.

Crazinerd may remove content at any time.


26. Prohibited Content

You may not upload, post, send, or share content that:

  1. Is illegal.
  2. Is sexually explicit.
  3. Exploits or endangers minors.
  4. Promotes violence or harm.
  5. Promotes illegal substances or illegal activities.
  6. Contains hate speech.
  7. Harasses or threatens others.
  8. Contains private information without consent.
  9. Is defamatory.
  10. Is fraudulent or misleading.
  11. Infringes copyright, trademark, privacy, or personality rights.
  12. Contains malware, viruses, or harmful code.
  13. Damages Guestlist, Crazinerd, users, hosts, venues, or partners.
  14. Violates platform rules, venue rules, or applicable laws.

27. User Conduct

You agree not to:

  1. Use Guestlist for unlawful purposes.
  2. Use Guestlist if you are under 18.
  3. Create fake or duplicate accounts.
  4. Submit fake IDs or documents.
  5. Impersonate another person, host, venue, or business.
  6. Harass, threaten, abuse, or exploit others.
  7. Misuse RSVPs or QR codes.
  8. Scrape, copy, or extract platform data.
  9. Interfere with platform security.
  10. Reverse engineer, attack, or exploit the platform.
  11. Upload viruses or malicious code.
  12. Access another user’s account.
  13. Manipulate reviews, listings, analytics, payments, or RSVPs.
  14. Use bots or automated systems without permission.
  15. Sell or transfer accounts.
  16. Damage the reputation or operation of Guestlist or Crazinerd.

28. Host Conduct

Hosts agree to:

  1. Provide accurate listing information.
  2. Honour approved guestlist benefits where reasonably possible.
  3. Clearly state arrival times, dress codes, age restrictions, and procedures.
  4. Treat goers respectfully.
  5. Use RSVP information only for event purposes.
  6. Comply with venue, safety, alcohol, and event laws.
  7. Not mislead users about free entry, drinks, benefits, or VIP access.
  8. Not create fake listings.
  9. Not manipulate platform analytics.
  10. Not discriminate unlawfully.
  11. Not misuse personal information.
  12. Keep contact and venue details accurate.

Crazinerd may suspend or remove hosts who breach these obligations.


29. Venue and Event Responsibility

Guestlist is a platform that connects goers, hosts, venues, and listings.

Crazinerd does not own, manage, operate, control, supervise, or guarantee venues or events unless expressly stated.

Hosts and venues are responsible for:

  1. Event safety.
  2. Venue access control.
  3. Door policy.
  4. Security.
  5. Crowd management.
  6. Legal compliance.
  7. Alcohol licensing.
  8. Age restriction enforcement.
  9. Guestlist fulfilment.
  10. Benefits promised in listings.
  11. Staff conduct.
  12. Venue rules.

Crazinerd is not liable for venue incidents, cancelled events, refused entry, crowd issues, safety failures, host misconduct, or venue misconduct, except where liability cannot legally be excluded.


30. Safety

You are responsible for your own safety when attending venues or events.

You should:

  1. Confirm event details before travelling.
  2. Carry valid identification.
  3. Follow venue rules.
  4. Arrange safe transport.
  5. Avoid sharing sensitive personal information with strangers.
  6. Report suspicious behaviour to Guestlist and venue staff.
  7. Contact emergency services where necessary.

Crazinerd does not guarantee the safety of any venue, event, host, user, or third party.


POPIA AND PRIVACY TERMS

31. POPIA Compliance

Crazinerd respects your privacy and is committed to protecting your personal information in accordance with the Protection of Personal Information Act, 4 of 2013, commonly known as POPIA, and other applicable South African privacy laws.

POPIA aims to promote the protection of personal information processed by public and private bodies and introduces conditions for lawful processing of personal information.

By using Guestlist, creating an account, submitting your profile information, uploading your ID document, verifying your cellphone number, making a payment, RSVPing to a guestlist, creating a host listing, sending messages, posting reviews, or using any feature of the platform, you agree that Crazinerd may collect, process, store, verify, use, and share your personal information as described in these Terms and our Privacy Policy.


32. Personal Information We May Collect

Crazinerd may collect and process:

  1. Name and surname.
  2. Email address.
  3. Cellphone number.
  4. Date of birth or age.
  5. Gender.
  6. Profile picture.
  7. Gallery images or videos.
  8. Brief bio.
  9. Social media handles.
  10. ID document or proof of age.
  11. Selfie or verification image, where required.
  12. Location data.
  13. Device information.
  14. Login information.
  15. Payment status and subscription information.
  16. RSVP history.
  17. Guestlist attendance information.
  18. QR code check-in information.
  19. Messages sent through the platform.
  20. Reviews submitted on the platform.
  21. Host, venue, or business information.
  22. Support requests and complaints.
  23. Analytics and usage data.
  24. Security and fraud prevention data.
  25. Any other information you submit to Guestlist.

33. Why We Process Personal Information

Crazinerd may process your personal information to:

  1. Create and manage your Guestlist account.
  2. Confirm that users are 18 years or older.
  3. Verify your identity.
  4. Verify your cellphone number.
  5. Process subscriptions and payments.
  6. Allow goers to view and RSVP to guestlists.
  7. Allow hosts to manage RSVPs.
  8. Show listings near your location.
  9. Send event reminders, RSVP confirmations, and guestlist details.
  10. Provide QR code identity and check-in features.
  11. Moderate reviews and content.
  12. Provide customer support.
  13. Detect and prevent fraud, fake accounts, duplicate accounts, abuse, and misuse.
  14. Protect users, hosts, venues, and the platform.
  15. Comply with legal, regulatory, tax, accounting, and security obligations.
  16. Improve platform features, performance, safety, and user experience.
  17. Send marketing or promotional messages where permitted by law.

34. Legal Basis for Processing

Crazinerd processes personal information where:

  1. You have given consent.
  2. Processing is necessary to provide Guestlist services.
  3. Processing is necessary to perform a contract with you.
  4. Processing is necessary to comply with the law.
  5. Processing is necessary to protect legitimate interests of Crazinerd, Guestlist, users, hosts, venues, or the public.
  6. Processing is necessary to detect fraud, prevent abuse, and maintain platform safety.

35. ID Documents and Special Care Information

Because Guestlist is intended only for users who are 18 years or older, Crazinerd may require users and hosts to submit an ID document, proof of age, selfie, phone verification, or other verification information.

By submitting verification information, you confirm that:

  1. The information is true, accurate, and belongs to you.
  2. You are at least 18 years old.
  3. Crazinerd may process this information for age verification, identity verification, safety, fraud prevention, and legal compliance.
  4. Crazinerd may reject, suspend, or terminate your account if verification fails.

Crazinerd will take reasonable steps to protect verification information and restrict access to authorised persons, systems, contractors, and service providers.


36. Sharing of Personal Information

Crazinerd may share personal information with:

  1. Payment providers, including PayFast or any replacement payment provider.
  2. Cloud hosting and database providers.
  3. Verification and security service providers.
  4. Email, SMS, WhatsApp, and push notification providers.
  5. Analytics and crash-reporting providers.
  6. Customer support tools.
  7. Hosts and venues, where necessary for RSVP and guestlist management.
  8. Law enforcement, regulators, courts, or government authorities where required by law.
  9. Professional advisers, including lawyers, accountants, auditors, and compliance consultants.
  10. Business partners or service providers who assist in operating Guestlist.

Hosts may receive limited user information required to manage guestlists, such as names, surnames, RSVP status, arrival details, and other information needed for venue entry.

Hosts must only use this information for lawful guestlist and event management purposes.


37. User Rights Under POPIA

Subject to applicable law, you may have the right to:

  1. Request access to your personal information.
  2. Request correction of inaccurate or outdated personal information.
  3. Request deletion of personal information where legally permitted.
  4. Object to certain processing.
  5. Withdraw consent where processing is based on consent.
  6. Request details of third parties who have received your personal information.
  7. Lodge a complaint with the Information Regulator of South Africa.

The Information Regulator is empowered to monitor and enforce compliance with POPIA, and users may lodge POPIA complaints where they believe their personal information has been processed unlawfully.

38. Information Officer

Crazinerd may appoint or register an Information Officer or Deputy Information Officer as required by POPIA and PAIA.

The Information Regulator states that public and private bodies are required to register Information Officers as outlined in POPIA.

39. Data Security

Crazinerd will take reasonable technical and organisational measures to protect personal information against loss, unauthorised access, misuse, disclosure, alteration, or destruction.

These measures may include:

  1. Access controls.
  2. Authentication.
  3. Encryption where appropriate.
  4. Secure cloud storage.
  5. Internal policies.
  6. Monitoring.
  7. Backups.
  8. Staff and contractor access restrictions.
  9. Security reviews.
  10. Fraud detection.

You are responsible for keeping your login details secure and notifying us immediately if you suspect unauthorised access to your account.


40. Data Retention

Crazinerd will retain personal information only for as long as reasonably necessary for the purposes for which it was collected, including:

  1. Providing Guestlist services.
  2. Maintaining account history.
  3. Processing payments and subscriptions.
  4. Managing disputes and complaints.
  5. Preventing fraud and abuse.
  6. Complying with legal, tax, accounting, security, and regulatory obligations.
  7. Enforcing these Terms.

Where information is no longer required, Crazinerd may delete, anonymise, or securely archive it.


41. Cross-Border Processing

Guestlist may use cloud, hosting, analytics, communication, payment, or security providers located outside South Africa.

By using the platform, you agree that your personal information may be transferred to, stored in, or processed in other countries where our service providers operate, provided that reasonable steps are taken to protect your personal information in line with POPIA.


42. Direct Marketing

Crazinerd may send you marketing messages about Guestlist, promotions, subscriptions, boosts, venue offers, events, features, or related services where permitted by law.

You may opt out of marketing messages.

However, even if you opt out of marketing, Crazinerd may still send important service, payment, security, RSVP, verification, legal, and account-related communications.


43. Privacy Policy

These Terms should be read together with the Guestlist Privacy Policy.

If there is a conflict between these Terms and the Privacy Policy regarding personal information, the Privacy Policy will apply to the extent of the conflict.


GENERAL LEGAL TERMS

44. Admin Moderation

Crazinerd may moderate:

  1. Profiles.
  2. Host applications.
  3. IDs and verification documents.
  4. Listings.
  5. Reviews.
  6. Messages.
  7. Images and videos.
  8. RSVPs.
  9. Payments and subscription access.
  10. Suspicious activity.

Crazinerd may take action without prior notice where necessary to protect users, hosts, venues, the platform, or legal compliance.


45. Suspension and Termination

Crazinerd may suspend, restrict, or terminate your account if:

  1. You breach these Terms.
  2. You are under 18.
  3. You submit false information.
  4. You misuse ID verification.
  5. You commit fraud.
  6. You harass or abuse others.
  7. You misuse payments, RSVPs, messages, reviews, QR codes, or listings.
  8. Your conduct creates risk for Crazinerd, Guestlist, users, hosts, or venues.
  9. Required by law.
  10. We reasonably believe your account is unsafe or suspicious.

If your account is terminated, you may lose access to your profile, subscription, RSVPs, listings, reviews, messages, and content.


46. Intellectual Property

Guestlist is owned and operated by Crazinerd.

All rights, title, and interest in and to Guestlist, including the app, website, software, source code, databases, design, branding, logos, trademarks, business processes, features, dashboards, algorithms, QR code systems, subscription systems, verification systems, and related intellectual property, belong to Crazinerd or its licensors.

You may not copy, reproduce, modify, distribute, reverse engineer, scrape, sell, or exploit any part of Guestlist without written permission from Crazinerd.


47. Third-Party Services

Guestlist may integrate with third-party services such as:

  1. PayFast.
  2. Maps providers.
  3. Cloud hosting providers.
  4. Analytics providers.
  5. Messaging providers.
  6. Email providers.
  7. WhatsApp communication providers.
  8. SMS providers.
  9. Push notification providers.
  10. App stores.
  11. Social media platforms.

Your use of third-party services may be subject to their own terms and privacy policies.

Crazinerd is not responsible for third-party outages, errors, data practices, fees, delays, or service interruptions.


48. Platform Availability

Crazinerd aims to provide a reliable platform, but we do not guarantee uninterrupted or error-free service.

Guestlist may be unavailable due to:

  1. Maintenance.
  2. Updates.
  3. Server issues.
  4. Internet problems.
  5. Third-party outages.
  6. Security incidents.
  7. Payment provider problems.
  8. App store issues.
  9. Force majeure events.

Crazinerd is not liable for temporary downtime, delays, bugs, data loss, missed RSVPs, failed notifications, or service interruptions, except where required by law.


49. Changes to the Platform

Crazinerd may change, add, remove, suspend, or discontinue features at any time.

This may include changes to:

  1. Subscription pricing.
  2. Free and paid access.
  3. Host approval requirements.
  4. RSVP rules.
  5. Boost features.
  6. Verification systems.
  7. Review moderation.
  8. Messaging features.
  9. Location-based discovery.
  10. Admin tools.
  11. Platform design.

We may notify users of major changes where reasonably required.


50. Disclaimers

Guestlist is provided on an “as is” and “as available” basis.

Crazinerd does not guarantee that:

  1. Listings will be accurate.
  2. Events will happen.
  3. Hosts will approve RSVPs.
  4. Venues will allow entry.
  5. Guestlist benefits will be provided.
  6. Boosts will generate results.
  7. Reviews are fully accurate.
  8. Users are safe or trustworthy.
  9. The platform will always be available.
  10. Notifications will always be delivered.
  11. Location results will always be correct.
  12. Verification removes all risk.

51. Limitation of Liability

To the maximum extent allowed by law, Crazinerd will not be liable for:

  1. Refused venue entry.
  2. Cancelled events.
  3. Venue safety incidents.
  4. Host misconduct.
  5. User misconduct.
  6. Incorrect listing information.
  7. Failed notifications.
  8. Payment provider errors.
  9. Loss of data.
  10. Loss of profits.
  11. Loss of business.
  12. Indirect or consequential damages.
  13. Travel costs.
  14. Wasted time.
  15. Third-party claims.
  16. Unauthorised account access caused by user negligence.

Where Crazinerd is legally liable, our liability will be limited to the amount you paid to Crazinerd for Guestlist services in the previous 3 months, unless the law requires otherwise.


52. Indemnity

You agree to indemnify and hold Crazinerd harmless from any claims, losses, damages, costs, penalties, or expenses arising from:

  1. Your breach of these Terms.
  2. Your misuse of Guestlist.
  3. Your content.
  4. Your event, venue, or listing.
  5. Your conduct toward another user.
  6. Your violation of law.
  7. Your misuse of personal information.
  8. Your payment disputes.
  9. Your fraud or misrepresentation.
  10. Your infringement of another person’s rights.

53. Consumer Protection

Nothing in these Terms is intended to limit any rights you may have under applicable consumer protection laws.

If any provision of these Terms is found to be unlawful or unenforceable, that provision will be limited or removed, and the remaining Terms will continue to apply.


54. Complaints and Support

Users may contact Crazinerd for support, complaints, safety reports, payment issues, verification problems, listing concerns, or abuse reports.

55. Reporting Users, Hosts, Listings, or Reviews

You may report content or behaviour that violates these Terms.

Crazinerd may investigate and take action, including:

  1. Warning the user.
  2. Removing content.
  3. Restricting features.
  4. Suspending the account.
  5. Terminating the account.
  6. Referring the matter to authorities where appropriate.

Crazinerd is not required to disclose the outcome of moderation investigations.


56. Marketing, Promotions, Referrals, and Rewards

Guestlist may run promotions, referral campaigns, discounts, competitions, affiliate programmes, host programmes, missions, rewards, or special offers.

These may be subject to additional rules.

Crazinerd may change, pause, cancel, or revoke promotional offers where necessary to prevent abuse, fraud, errors, or misuse.

Rewards, credits, bonuses, or promotional balances may not be transferable or redeemable for cash unless expressly stated.


57. Affiliate, Referral, and Mission Programmes

Guestlist may allow users, goers, hosts, or partners to participate in referral, affiliate, mission, or reward programmes.

Crazinerd may set eligibility requirements, targets, payout thresholds, reward rates, fraud checks, and programme rules.

Crazinerd may withhold, reverse, or cancel rewards if:

  1. Referrals are fake.
  2. Users create duplicate accounts.
  3. Payments are refunded or reversed.
  4. Activity is fraudulent.
  5. The user violates these Terms.
  6. The programme is abused.
  7. Required verification is incomplete.
  8. The referred user does not meet qualifying criteria.

Crazinerd may change or end any programme at any time.


58. App Store Terms

If you download Guestlist from the Apple App Store, Google Play Store, or another app marketplace, your use may also be subject to that store’s rules.

If app store terms conflict with these Terms, the app store terms may apply only to the extent required by the relevant app store.


59. Governing Law

These Terms are governed by the laws of the Republic of South Africa.

Any dispute will be dealt with by the appropriate South African court, tribunal, regulator, or dispute resolution body, unless another process is required by law.


60. Changes to These Terms

Crazinerd may update these Terms from time to time.

The latest version will be made available on Guestlist or on the applicable website.

If you continue using Guestlist after the updated Terms become effective, you agree to the updated Terms.

If you do not agree to the updated Terms, you must stop using Guestlist.
